A Pierre man has been indicted by a federal grand jury on child pornography charges. David Foster was indicted Wednesday on charges of Receipt and distribution of Images Depicting the Sexual Exploitation of Minors and Possession of Child Pornography. The 34-year-old has pleaded not guilty to the charges. The indictment alleges that Foster knowingly received and distributed images that depicted minors engaged in sexually explicit conduct. The indictment also claims Foster was in possession of child porn between October 5th of 2016 and May 4th of last year. The Department of Homeland Security is conducting the investigation. Foster is out of jail on bond pending trial. The maximum penalty if convicted of the charges is up to 40 years in prison and or a 500-thousand dollar fine. Supervised release for life is also a possible penalty as is restitution and a 200-dollar assessment to the Federal Crime Victim’s Fund. A tentative trial date is set for March 20th.
